تطورت مهام الأمم المتحدة ذات الطابع الإنساني في أعقاب سقوط القطبية الثنائية و انتهاء الحرب الباردة حيث يعد التدخل الإنساني إجراء مفضلا و مشروعا على أساس ما ورد في ميثاق الأمم المتحدة من أجل حماية السلم و الأمن الدوليين أمام تراجع مبدأ السيادة و ما زاد من الاهتمام الدولي بالبيئة هو أن الأضرار البيئية لا تقتصر على الدولة مصدر التلوث و إنما تمتد آثارها إلى غيرها من الدول و يعتبر التدخل الإنساني لحماية البيئة من الآليات التي أثارت جدلا واسعا في القانون الدولي باعتبار مبدأ عدم التدخل من المبادئ الأساسية التي تعمل هيئة الأمم المتحدة وفقها إلا أن استثناء ورد في ميثاق الأمم المتحدة بموجب الفصل السابع بشأن تهديد الأمن و السلم الدوليين مع وجود واجب عام يفرض نفسه على الدول يتمثل في مسؤولية الحماية الدولية لحق الإنسان في بيئة سليمة رغم أن البيئة كحق لم ينصص عليها في مواثيق حقوق الإنسان إلا بصورة عابرة و محاولة وضعها تحت مسمى حقوق التضامن باعتبارها إرثا عالميا مشتركا منعا للإخلال بقواعد القانون الدولي و مبادئ الإنسانية.
و بما أن التدخل من أجل حماية البيئة طرح قائم فإن هدف هذا البحث هو دفع المشرع لوضع منظومة قانونية وطنية متكاملة تحمي الحقوق و الحريات متضمنة الحق في البيئة تفاديا للآليات الدولية.
و من أهم النتائج المتوصل إليها أن تنوع أسباب و مبررات الاهتمام الدولي بالبيئة الطبيعية اقتصاديا اجتماعيا و سياسيا حتى تكون ذرائع لتبرير شرعية التدخل باسم حقوق الإنسان
Abstract EN
The humanitarian missions of the United Nations evolved in the aftermath of the fall of Polarity and the end of the Cold War.
Humanitarian intervention is the preferred and legitimate measure on the basis of the UN Charter to protect international peace and security.
Environmental damage is not limited to the country of origin but extends to other countries.
Humanitarian intervention to protect the environment is one of the mechanisms that has caused widespread controversy in international law; Intervention is an exception to the Charter of the United Nations under Chapter VII on the threat to international peace and security with the general duty to impose the responsibility of States to ensure a healthy environment.
Although the environment is not enshrined in human rights instruments, its attempt to establish it under the name Solidarity Rights is a common world heritage to prevent violations of the rules of international law and the principles of humanity.
Given the possibility of intervention in the field of environmental protection, the aim of this research is to push the legislator to develop an integrated national legal system that protects rights and freedoms, including ensuring the protection of environmental rights to avoid international mechanisms.
One of the most important results is that the reasons and justifications for international attention to the natural environment vary economically, socially and politically; and even to be excuses to justify the legitimacy of intervention in the name of human rights.
