يشكل التعسف في استعمال الحق نظرية عامة تطبق على جميع الأفعال الصادرة عن الفرد و لو تدخل في ضمن ممارسة حقه ضمن الإطار الذي يسمح به القانون غير أنه يخالف الوظيفة الاجتماعية للحق لأن طبيعة الحق لا يضر بالغير و لا يمكن أن يجانب مبدأ حسن النية و ذلك باتيان الفرد سلوك يتضمن الغش.
وردت نظرية التعسف في استعمال الحق في ظل الأمر 75-58 في المادة 40 قانون مدني و ذلك في الكتاب الذي يتضمن الأحكام العامة غير أنه بتعديل القانون المدني بموجب القانون رقم 05-10 المؤرخ في 20 يونيو 2005 نقلت المادة 40 السالفة الذكر إلى نص المادة 124 مكرر قانون 05-10 و ذلك في الباب الثاني المتضمن الالتزامات و العقود يثور السؤال عن مدى امكانية تأسيس الشرط التعسفي على نظرية التعسف في استعمال الحق.
Abstract EN
Abu of right is a general theory that applies to all acts performed by a person who is not prohibited by a rule of law may be contrary to the social function of law, that of not harming the other and is not contrary to the principle of good liver.
The theory of the Abu of right is quoted by the ordinance 75-58 article 40 of civil code in the book containing the general rule, May the modification of civil code by the law n ° 05-10 which dated January 20, 2005 Article 40 precedes been transferred to Article 124 bis of Law 05-10 in Chapter Two containing the obligations and contracts, so a question arises on the basis of the unfair clause on the theory of law.
