بعد عقود من الحكم الاستبدادي شهدت منطقة آسيا الشرقية موجة من التحول الديمقراطي و ذلك منذ منتصف الثمانينيات في كل من كوريا الجنوبية تايوان تايلندا منغوليا إندونيسيا و لقد رافق هذه التحولات السياسية بروز محاكم دستورية قوية في المنطقة.
علما أن المنطقة لم تعرف سوابق عديدة لقضاء دستوري مستقل و فعال في حماية الحقوق أو مواجهة الحكومة.
تتناول هذه المقالة تجارب استقلالية مؤسسات القضاء الدستوري في هذه الدول المذكورة أعلاه
Abstract EN
After decades of authoritarian rule, East Asia has seen a wave of democratic transformation since the mid-1980s in South Korea, Taiwan, Thailand, Mongolia and Indonesia.
These political shifts were accompanied by the emergence of strong constitutional courts in the region.
The region has not known many precedents for an independent and effective constitutional judiciary in the protection of rights or confronting the government.
This article discusses the experiences of the independence of the institutions of constitutional justice in these countries mentioned.
