It is commonly held that the exceptional situation caused by covid 19 pandemic has had a tremendous impact over commercial obligations.

This has been quiet clear as far as commercial rents whose economies have witnessed big distrubtions are concerned, notably with the law of March 20, 2020.

In this regard, the French government has decided to postpone the commercial rents payment despite the fact that such a measure has not included all lessess; that pushed them to look for other mechanismes that may exempt them from fullfing their commercial commitments by having recourse to the theory of major force and emergency cases.

We shall shed light over the Legal solutions to the impact of Covid 19 on the lessee obligations as to the payment of commercial rents in accordance with law and French case law.
