The nursery dwelling has sparked great controversy in this era, especially in societies that live in difficult social conditions and suffer from a housing crisis, such as the Algerian society, where courts have khown severe conflicts between divorced spouses over marital housing, especially after the recent amendment that effected the Algerian family law, which decided the right to housing or wages for the divorced women in order to ensure a change that serves the interest of the child in a view to protect and take care of him from homelessness and loss, as well as to heat him from the psychological effects that befall him after the divorced.

between this conflict, we saw dealing with this adjustement according to what was stated by Islamic fiqh and comparing it with what was stated in the Algerian family law.
