This paper has discussed with critical and analytical stady an important issue relate to tourism considering that it is one of the modern economic resources that worlds nations depend on it, and we have focused on cultural tourism which involve visiting archaeological location and getting to know about different cultural property, that express the spirit of human civilization.

however, this does not prevent the existence of many negative effects resulting from it, Especially, the behavior of tourists towards the host country, such as breaking the laws and rigimes, The study clarified the concept of tourist crimes and cultural property, Then we discussed some types of these crimes, such as stealing and smuggling of cultural property, illicit trafficking of cultural property And how did the criminal Algerian policy treat the issue of criminalizing these behaviors in the domestic laws and some Arabic countries' legislations, such as the Syrian, Iraqi and Egyptian legislators.
