La norme a besoin d'être clarifie surtout lors de différents entre Etats et investisseurs étrangers, cette tâche ardue revient aux arbitres des tribunaux arbitraux qui dans leurs majorités choisissent de recourir à la notion de protection des attentes légitimes de l'investisseur étranger comme critère utile pour définir cette norme.

Most foreign investment protection agreements require that foreign investors receive fair and equitable treatment, but the content of this standard is far from being precisely defined.
