A valid appointment grants an administraive position to the person joining public function, if so, he is attributed the quality of public agent and not public officer, Any candidate nominated to occupy a position in public function, is employed as a trainee, and this quality ensues specific rights and obligations, and he is bound by this quality before his confirmation, to be submitted to a probation period, that must be performed successfully.

The public agent is expected in the probation period to assert his abilities and skills in performing the task he was appointed for, it is deemed as a practical exam to confirm the agent's skills.

There are some provisions which govern the probation period in terms of performance, evaluation and effects.
