Today in the society, the woman is accompanied by some social conditions constitute a discriminatory sexual perspective against her in front of the man, like those attached to her biological nature as a female, that diminish the value of woman in society, as her inefficiency in assuming positions and political responsibilities, or her limited mental capacity.

These circumstances, over time, constituted gender discrimination that produced the vulnerability of women in society.

The woman vulnerability complicates the process of achieving the law the equality among all those addressed with, so, her fairness would be through producing preferential qualitative rules in her weaknesses, and that is a sort of women empowerment.

But in the State of Law, supremacy of the constitution requires finding a constitutional foundation for that will, so the question arises is whether the constitutional founder constitutes to the empower Algerian women, and how.
