Abstract EN

The AFCSI is responsible for organizing and coordinating the religious affairs of the Ahl al-Sunnah wal-Jama’ah in the three provinces of Hormozgan, Fars, and Bushehr, located in the south of Iran.

This Committee is trusted within the people and the government of Iran, to the point where the justice courts refer to it for matters of fiqh (jurisprudence) related to the Ahl al-Sunnah; especially in the field of _personal affairs.

This committee has issued various fatwas (religious rulings) on contemporary subjects and identifying its foundations for ijtihad (judgement) seems necessary.As the Ahl al-Sunnah in the south of Iran are upon the Shafi 'i madhhab (school of thought), the muftis are required to issue fatwas in accordance with the madhhab of the fatwa seekers; however, apparently on occasion we can see a noncompliance with the Shafi’i madhhab.

The AFCSI’s occasional contradiction with the rulings of the Shafi 'i madhhab, emphasizes the need for clarifying this Committee’s foundations for ijtihad.

The Book, the Sunnah, fyma’ (consensus), and Qias (analogy) are the most important foundations for the Committee s ijtihad.

The Committees approach to the Book and Sunnah is an objective approach.

Although the Committee acknowledges qias as one of the foundations for its ijtihads, applying qias is rarely used.

In this article, some of the AFCSI's rulings have been discussed in a descriptive analytical fashion to identify their foundations for ijtihad by analyzing their fatwas.
