The importance of preserving the medical secret is evident in the fact that it is one of the most important rights that the Algerian legislator guarantees to the patient, given the damages that may be caused to him when his secret is disclosed by his physician or others who have a relationship with the medical field, the disclosure of the medical secret is considered a crime punishable by law when its pillars are available.

In spite of this, the legislator permits the disclosure of the medical secret in some cases, the importance of determining the criminal responsibility for the crime of disclosing a medical secret appears when its pillars are available in protecting the private interests of individuals and the public interest of society.

The study also aims to clarify the subject of the crime of disclosing the medical secret.

and highlighting the efforts of the Algerian legislator in tackling that crime, accordingly, we study the subject through a basic problem: when can we be in front of a criminal responsibility when revealing a medical secret?
