ظهرت النيابة العامة كنتيجة لتخلي النظم الإجرائية عن نظام الاتهام الشعبي لتصبح هي الممثل القانوني للمجتمع و المسؤول عن حماية أمنه و استقراره و مع الطبيعة المتميزة للعمل الذي تقوم به نشأ خلاف فقهي حول ما إذا كانت تمارس عملا قضائيا أم إداريا خاصة أن أعضاءها ينفردون بصلاحيات استثنائية لا يتمتع بها قضاة الحكم كخضوعهم للتبعية التدرجية و عدم إمكانية ردهم.
Abstract EN
The Public Prosecution has emerged as a result of the abandonment of the procedural system from the popular indictment system to become the legal representative of the society responsible for the protection of its security and stability and the distinct nature of its work.
Enjoyed by the judges of the judgment, as subject to progressive subordination and their inability to respond.
