Abstract EN

This research study tackles the topic of the rights of the beneficiaries and ways to protect them in a time share contract.

It focuses on the beneficiary's rights, as a buyer or a tenant of the tourist unit, to obtain a detailed brochure with an accurate description of the unit mentioned in the contract and important dates.

The brochure should stipulate the beneficiary's right to stay in the unit and to conduct any legal transactions such as selling it, renting it, giving it away as a gift, bequeathing it, donating it as an endowment, regarding it as part of one's own property in the will, or exchanging it for another timeshare unit at another place or time.

All of this is to be authorized in accordance with the Islamic jurisprudence.

The beneficiary should also have the right to cancel the contract or ask for a refund within the stipulated period.

The study also focuses on ways to protect the beneficiary before and after signing the contract.
