يتناول البحث مسلكا عمليا مهما في اجتهاد التنزيل و التطبيق هو مسلك العدول عن الأصل الذي غايته الحرص على تنزيل الأحكام الشرعية تنزيلا سليما و يحقق مقصدي العدل و المصلحة الذين عليهما مبنى الشريعة.
و تأتي أهمية البحث في اعتبار ما يجليه من كون مسلك العدول عن الأصل في الاجتهاد له ما يدعم جانبه في الشريعة من خلال مظهرين متداخلين فيها هما: جانب العفو و جانب الرخص الشرعية وذلك ببيان الحقيقة اللغوية و الاصطلاحية لكل من لفظي العدول و الأصل و من ثم تحديد المدلول التركيبي لمصطلح العدول عن الأصل مع الوقوف على حقيقة العفو و الرخصة الشرعية
Abstract EN
This research deals with the concept of revocation of the general principle as being a practical attitude in revelation, by demonstrating its linguistic and terminological reality, and then determining the most important of its aspects and general evidence in the sharea through two important aspects of the law Divine are: amnesty, and legitimate authorizations.
