The doctrinal texts in the early centuries of islamic authorship have consistently brought some jurisprudential issues, and to emphasize themas the distinguishing elements among all the sunnis and their opponents innovators, they were guided by circumstantial purposes called for by scientific necessity at the time.

But with the succession of generations this historical conditionality has been ignored(epistemic purpose), so called the speech of faith in the in lesson of jurisprudence, which led to the enlargement of the issues of frivolity and printed with certainty, thus turning into aweak factor that is flawed to the knowledge of jurisprudence and limits their systematic and functional performance.

This paper seeks to examine this problem and to investigate the most important causes and motivations.

It is also asked to reveal the most important influences in the contemporary jurisprudence lesson.
