Abstract EN

This study has presented a rooting study in the fallen reasoning of the contemporary financial dealings, and that through the achievement of the purposes and the consideration of the appropriate description according tothe fundamentals of the Sharia and the law.

And the problematic of the study that this research aimed to treat lies in what are the considered restrains in achieving the purpose of the contemporary financial dealings, either within its simple or compound picture? And to what extent the harmony exists between the fundamentals of the Sharia and fundamentals of the law in regard to these restrains? And the researcher has followed the inductive and the analytical method and in accordance to which the outline of the research was split into two sections and an introduction and a onclusion, and among the most eminent findings the research has arrived to are: the prohibition of scams, the achievement of the urposes of the contract during its framing and the consideration of its fat in order to avoid the occurrence of what the legislator has banned to thrust a corrupt and to gain an interest.
