هذا البحث يعنى ببيان موقف عالمين محققين من علماء المسلمين وهما ابن تيمية و ابن القيم من أصل من أهم أصول استنباط الأحكام الشرعية العملية و هو عمل أهل الدينة وذلك لأن الإمام مالكا قد بنى كثيرا من آرائه الفقهية على هذا الأصل و خالفه في ذلك جمهور الأئمة ولما كانت لهذين الإمامين -ابن تيمية و ابن القيم- اليد الطولي في تقرير الأحكام الشرعية العملية ترجيحا و استدلالا و كان هذا الأصل أصلا مختلفا فيه بين الأئمة كان من مقتضى ذلك تحقيقهما في هذا الأصل المهم و بيان قوته أو ضعفه أو اختلاف مراتبه قوة و ضعفا مما ينتج عن ذلك: إما توافقا كليا بينهما أو اختلافا كليا أو توافقا من وجه و اختلافا من وجه سواء قل أو كثر
Abstract EN
This study exposes the position of Ibn Taymia and Ibn Al-Qayim, two Muslim scholars, regarding considering the deeds of the people of Madina as being a principle to consider in extracting Shariah rules.
As a matter of fact, Imam Malik founded many of his rules upon this principle which was a subject of disagreement among the majority of Muslim scholars.
This study compares and contrasts the positions of two strong contributors in approving Shariah rules: Ibn Taymia and Ibn Al -Qayim by showing how harmonious their positions were in invesigating the strengths and the weaknesses of this principle.
