لم تعرف المسؤولية الجزائية إلا للشخص الطبيعي لمدة طويلة من الزمن إلى أن ظهر جدل فقهي بين مؤيد و معارض لإقرار المسؤولية الجزائية للشخص المعنوي فتنوعت التشريعات بذلك إلى معترفة صراحة بإمكانية قيام هذه المسؤولية و أخرى منكرة و مستبعدة لإمكانية مساءلة الشخص المعنوي جزائيا.
تشريعنا الوطني أخذ بالاتجاه المؤيد للمسؤولية الجزائية للشخص المعنوي و قد جاء ذلك بالتدريج انطلاقا من الاستبعاد الكلي مرورا بالإقرار الجزئي بها و ذلك بالتنصيص على شروط إذا ما توافرت قامت مسؤولية الشخص المعنوي الجزائية و منه يترتب للدولة الحق في عقابه بعقوبات نص عليها المشرع الجزائري.
Abstract EN
For a long period of Time , criminal liability had been known only for the natural person, until debate arose between partisans and opponents to enact the criminal liability of the moral person.
In this respect the legislations were diverse, between those who expressly recognize the possibility of existence of this liability and others who deny and dismiss the possibiliy of prosecuting the moral person in criminal matters.
Our national legislation has adopted the partisan current for the criminal liability of the moral person, by stipulating the required conditions for the criminal responsibility of the of the moral person.
If these conditions are met, the state may condemn it to penalties enacted by the Algerian legislator.

Pour une longue durée, la responsabilité pénale n’a été connue que pour la personne physique jusqu’au jour ou est apparu le débat de jurisprudence entre partisan et opposant pour édicter la responsabilité pénale de la personne moral.
A cet égard, les législations ont été diverses, entre celles qui reconnaissent expressément la possibilité de l’existence de cette responsabilité et d’autres qui nient et écartent la possibilité de poursuivre la personne morale en matière pénale.
Notre législation nationale a adopté le courant partisan pour la responsabilité pénale de la personne morale, chose qui est venue progressivement procédant de l’écart total passant par sa déclaration partielle, et ce en citant des conditions.
et si ces dernières existent, la responsabilité pénale de la personne morale y est, sur ce, l’état peut le condamner à des pénalités édictées par le législateur Algérien
