With the emergence of the codification movement which affected most of the principles and rules of international criminal law, in particular after the conclusion of treaties and agreements on basic systems, and the creation of judicial mechanisms, the penalties prescribed for the Most international crimes were determined after it was difficult to determine them because of what fell under customary rules and what is known about those rules in terms of ambiguity in Determining the Rules of Criminalization and again minus the rules of punishment.

Our subject is linked to the status and the penalties it decides for crimes that fall within the jurisdiction of the International Criminal Court, and article 77 thereof is the basis of these penalties, as they are been perceived and represented by life imprisonment and imprisonment for a number of years not exceeding 30 years, in addition to the additional penalties represented in the financial fine and the confiscation of all the proceeds of crime
