Abstract EN

The research paper discusses the issue of the blind man when he divorces his wife by way of li'aan (an oath of condemnation that the wife committed adultery) and its legality as well as the opinions of Islamic scholars about this issue.

It is a comparative study that focuses on the jurisprudence of such issue according to the six well-known Islamic schools of Hanafi, Maliki, Shafii, Hanabilah, Dhahiriyah, and Zaydiyah .

This research contains three sections.

The first section focuses on the meaning of li'aan and its legality.

The second sections discusses its conditions, and impacts that may happen on the two spouses .

The third section is about li'aan of the blind man when he accuses his wife of committing adultery without having evidence or seeing her doing this.

This study highlights the opinions of the scholars according to the six schools on this matter.

It displays the evidences of the scholars and discusses the matters that are in common among these scholars as well as those matters in which they differ.

After that, the researchers chose the proponderant opinion clarifying the reasons behind such choice.
