This study aims to investigate one of the main principles of the Shiah Sect dogma ithni 'ashriah (followers of the twelve Imams).
It investigates Wilajat Al- Fageeh (ruling by the Islamic Jurist).
It is the principle upon which their state is based.
They make the jurist a deputy for the absent Imam and ruling on behalf of him until the Imam appears and ends all their sufferings and punishes those who did not support the followers of the prophet family members.
This principle ignores the Islamic Sharia which is based on the Holy Quran and Prophetic traditions.
It also rejects the mind, which contrasts their beliefs.
The researcher finds out that this principle was not one of the original fundamentals of shiah (ithni 'ashriah) dogma but it has been created for certain necessities and it passed through different stages until it has been generalized by Imam Al-Khamini.
However, it has been opposed by some of the ithni 'ashriah themselves
