Summary: This research deals with the impact of changing circumstances on the fall of custody due to marriage and waiver, through a look at the provisions of the Maghreb legislation in the matter, then the role of the judiciary in balancing what is written by the legal texts, and the search for the interest of the conmen to decide what he sees fit when considering the cases of dropping custody for the reasons mentioned.

It can be argued that the effect of changing circumstances imposes itself on the subject, as the judge must deal with these developments as stipulated in the law, on the one hand, and use discretion as permitted on the other.
