يعتبر الإشهار التجاري الركيزة الأساسية التي يقوم عليها النظام الاقتصادي باعتباره وسيلة من وسائل تسويق و البيع المسبق للسلع و الخدمات و باعتباره مظهر من مظاهر المنافسة المشروعة و لكن في وقت نفسه يمكن أن يتحول إلى وسيلة إضرار بالمستهلك بسبب المعلومات المغلوطة و الخادعة مما استدعى الأمر تدخل المشرع من خلال حظر هذا الفعل و اعتباره أحد الجرائم المنافية لقواعد و مبادئ الممارسات التجارية النزيهة.
