لقد خول التعديل الدستوري لسنة 2016 لرئيس الجمهورية حق تقرير الحالات الاستثنائية دون أن تشاركه في ذلك أي جهة أخرى، إلا أن هذا لا يعني أن رئيس الجمهورية غير مقيد في فرضها، إذ أنه مقيد بمجموعة من الضوابط الموضوعية و الشكلية المنصوص عليها دستوريا، حيث تتجلى هذه الأخيرة في استشارة مجموعة من الهيئات و الشخصيات الرسمية من بينها رئيس المجلس الدستوري.
Abstract EN
The constitutional council consists of 12 members.
Four members including the speaker and vice-president of the council appointed by the president of the republic.
The president of the constitutional council is distinguished from the rest of the membres by being appointed by consulted by the president of the republic in extraordinary circumstances
