Abstract EN

One of the most important problems facing the arbitration judiciary on the occasion of its consideration of petroleum disputes is the issue of the eligibility of the State and its legal persons in agreeing to arbitrate disputes concerning petroleum contracts.

In order to acquire the capital and advanced technology of foreign companies, Algeria resorted to joining the countries that recognize the eligibility after the absolute ban.

In this regard, we have studied the evolution of the Algerian legislator's position on arbitration in the field of petroleum contract disputes to which the State or one of its public legal persons is a party.
