يعتبر عقد الترخيص باستغلال العلامة التجارية من العقود المهمة التي ترد على اموال معنوية بهدف توسيع النشاط و زيادة الثقة في المنتوج باعتباره عقدا قائما على مشروع تجاري منتشر على نطاق واسع وله خصوصية تميزه عن غيره من العقود وقد نص عليه المشرع الجزائري بموجب الأمر رقم 03/06 المتعلق بالعلامات التجارية من حيث طبيعته القانونية و أنواعه و الحماية التي منحها المشرع له
Abstract EN
A license contract to exploit the trademark is an important contract that responds to moral money, with the aim of expanding activity and increasing trust in the product, as a contract based on a widely disseminated business that is distinct from other contracts.
Therefore, the Algerian legislature provided for by order N° 03/06 on trademarks, in terms of their legal nature and the protections granted by the legislature.
