في ظل التصاعد الخطير لحوادث المرور بالجزائر و حصيلتها المأساوية فقد أولى المشرع الجزائري على غرار غيره من التشريعات أهمية بالغة لحوادث المرور نظرا لخطورتها و ما بنجم عنها يوميا من خسائر فادحة سواء المادية منها أو البشرية و ما يترتب عن ذلك من آثار اجتماعية و اقتصادية على الفرد و المجتمع لذا استوجب الأمر توفير حماية قانونية سواء أكانت قبلية تتمثل في التشريعات الردعية للتقليص و التقليل من حوادث المرور وحماية مستعملي الطرقات من المخاطر الناجمة عنها و هو ما جاء به الأمر 01/04 المتعلق بتنظيم حركة المرور عبر الطرق و سلامتها وأمنها المعدل و المتمم بالقانون 04/16 المعدل و المتمم بالأمر 09/03 و سواء أكانت هذه التشريعات بعد وقوع حادث المرور و التي يهدف من خلالها المشرع الجزائري إلى حماية ضحايا هذه الحوادث أو ذوي حقوقهم
English Abstract
In light of the serious escalation of traffic accidents in Algeria and its tragic consequences, the Algerian legislator, like other legislations, has attached great importance to traffic accidents because of the gravity and daily consequences of heavy losses, both material and human, and the consequent social and economic effects on the individual and society.
Therefore, it is necessary to provide legal protection, whether it is a hamburger in the legislation of deterrent to reduce and reduce traffic accidents and protect the users of roads from the risks resulting from it, as stated in Order 01/04 on the regulation of road traffic and safety and security modified and complementary N 16.
