Abstract EN

Free and fair elections are those elections that reflect the will of the electorate, and this can only be achieved with adequate constitutional and legal guarantees that provide the necessary protection for the electoral process from any abuses that affect its credibility.

This paper deals with the constitutional control of the elections through an independent body as a guarantee for free and fair elections in the light of Arab experiences compared with the emphasis on the Algerian experience through the organic law of the elections 16/10 as well as the contents of the last constitutional amendment concerning the establishment of the Independent High Electoral Observation.
