يترتب عن الجانب الإجرائي لاتفاق التحكيم كونه تصرف قانوني اثرين أحدهما أثر إيجابي و هو ثبوت اختصاص قضاء التحكيم يتمثل في منح الاختصاص للهيئة التحكمية للنظر في موضوع النزاع و الثاني أثر سلبي هو سلب النزاع من سلطة ولاية القضاء و حرمان أطراف العقد من اللجوء إلى القضاء العادي بشأن النزاع الذي وقع الاتفاق على حله عن طريق التحكيم

The procedural aspect of the arbitration agreement as a legal act has two positive effects, one of which has the positive effect of confirming the jurisdiction of the arbitral judiciary, which is to grant jurisdiction to the arbitral tribunal to consider the subject of the dispute.
The agreement was signed on its dissolution through arbitration
