تمارس المحكمة الجنائية الدولية اختصاصها على أشد الجرائم خطورة و تتمثل فعاليتها في ملاحقة مرتكبيها تحقيقا لحماية حقوق الإنسان.
تحال القضايا إلى المحكمة الجنائية الدولية في ثلاث حالات: من قبل الدول الأطراف في النظام الأساسي بقرار من مجلس الأمن أو بالمبادرة التلقائية من قبل المدعي العام.
يعالج هذا المقال سلطة المحكمة الجنائية الدولية في متابعة مرتكبي الجرائم التي نص عليها نظام روما الأساسي في مادته الخامسة و مدى مساهمتها في حماية حقوق الإنسان من الانتهاكات الجسيمة.
فالغرض من دراسة هذا الموضوع هو تحديد الضمانات القانونية و الآليات العملية التي توفرها المحكمة الجنائية الدولية لتحقيق الحماية الضرورية اللازمة لحقوق الإنسان الأساسية و على هذا الأساس نطرح السؤال الآتي: ما مدى فعالية المحكمة الجنائية الدولية في حماية حقوق الإنسان و ما هو دور الجهات المخولة في الإحالة إلى المحكمة لقد اعتمدنا المنهج الوصفي التحليلي بصفة أساسية مع اللجوء إلى المنهج التاريخي أحيانا
Abstract EN
The international criminal Court exercises its jurisdiction over the most serious crimes and effectively prosecutes those responsible for the protection of human rights.
This article deals with the power of the International Criminal Court to prosecute the perpetrators of the crimes determined by the Rome Statute and its contribution in protecting against the serious violations.
Itaims at defining the legal guarantees and practical mechanisms to achieve such protection.
On this basis some questions arise how affective is the International Criminal Court? What is the role of the persons authorized to seize the Court? These questions will be answered in this paper wherein we relied on descriptive analytical and at times historical approaches when adequately necessary.
