يترتب على زوال ركن نية الاشتراك عدة آثار منها ما يتعلق بالشركة و منها ما يتعلق بالشركاء و بالنسبة للشركة فإن أثر زوال هذا الركن المعنوي أثناء حياتها الإجتماعية يختلف عن الأثر المترتب عن زوالها عند إبرام العقد ففي الحالة الأخيرة يترتب بطلان عقد الشركة بينما في الحالة الأولى فيترتب حل الشركة بواسطة حكم قضائي بعد طلب من أحد الشركاء خاصة في حالة وقوع خلاف مهم و جدي بين الشركاء يؤدي إلى عدم إمكانية الاستمرار.
و هو ما أجازه المشرع الجزائري لكن دون تحديد للأسباب المبررة للمطالبة بحل الشركة على عكس موقف المشرع الفرنسي الذي نص صراحة على أن الخلاف بين الشركاء بسبب زوال نية الاشتراك يعد أحد أهم الأسباب المبررة للمطالبة بحل الشركة.

The disappearance of the intention to participate has several effects, as for the company, the effect of the disappearance of this moral element during its social life differs from the effect of its demise when the contract is concluded, In the first case, the effect is the dissolution of the company by a judicial ruling after a request from one of the partners, especially in case of serious disagreement between the partners leading to the possibility of continuing.
Which was approved by the Algerian legislator, but without specifying the justifiable reasons for demanding the dissolution of the company, contrary to the position of the French legislator.
