Abstract EN

The Islamic sharia has paid great attention to the subject of filiation, so it has identified methods of proving it accurately and has referred to the (Liaâ~n) as the only mean of denying it.

The legislator has proceeded in the same way in the Family Code with regard to proof of parentage, while he did not regulate the (Liaâ~n) as a mean of denying parentage.

Although the Supreme Court tried to close this legal deficiency, the need for the legislator to intervene remains based on the fact that the (Liaâ~n) needs to be legalized by a legal definition, especially as it poses practical problems that need legislative resolution.
