Abstract AR
يكمن الهدف الأساسي من وجود الرقابة القضائية في حماية مبدأ المشروعية وعليه يجب أن تندرج جميع أعمال الإدارة العمومية ووظائفها في إطار القانون.
وفي حالة عدم إحترام القانون فتكون أعمالها غير مشروعة و بالتالي تتعرض إلى إلغائها من طرف الجهة القضائية المختصة.
لذا تعتبر الرقابة القضائية من المبادئ المسلم بها لقيام دولة القانون و المؤسسات و ركيزة من ركائز النظام الديمقراطي.
على هذا الأساس نص عليها الدستور الجزائري لسنة 1996 في مادته 161 كباقي دساتير دول العالم لحماية حقوق وحريات المواطن على وجه الخصوص وحماية مبدأ المشروعية على وجه العموم.

rctThe principle objective of judicial control lies in the protection of the principle of legality, thereforeall public administration functions must submit to the law.
However, in case of disrespectoflaw, the actions of public administrationbecomeillegal and thereforesubject to cancellation by the competentjudicialauthority.
Judicial control, as a result, isconsideredto bea recognizedprinciple for the establishment of the state of law and institutions, and a cornerstone of the democratic system.
On this basis, the Algerian Constitution of 1996 mentionedit, in its article 161, likeother constitutions of the world, and specificallyprotects the rights and freedoms of citizens and protects the principle of legality in general
