تزايدت أهمية الرقابة على دستورية القوانين في الوقت الحاضر نظرا لتحول معظم الدول من فكرة الدولة الحارسة إلى فكرة الدولة المتدخلة و هو ما ظهر بتدخل الدول في المجالات الاقتصادية و التجارية و الاجتماعية…وغيرها و من ثم كثرت القوانين المنظمة لسلوك الدول في هذه المجالات و تشابكت و هو الأمر الذي يخشى معه أن تتعارض بعض هذه القوانين مع الدستور.
و قد ساهم التعديل الدستوري الاخير لــــ2016 بإحداث العديد من المتغيرات تدعيما لمهام المجلس في عملية الرقابة القانونية من خلال تحديد شروط العضوية في المجلس من خلال استحداث نص المادة 184 دراستنا تقتصر على تحديد هذه الشروط و مدى تدعيمها لمهام المجلس الدستوري الحالي
Abstract EN
The importance of monitoring the constitutionality of the laws at the present time since most of the States shifted from the idea of the guardian state to the idea of the intervening state.
Hence, the laws regulating the behavior of the states increased in this regard, which is feared that some of these laws contradict the constitution.
The latter to 2016 by introducing many variables in support of the Council's functions in the process of legal oversight by defining the conditions of membership in the Council through the introduction of the text of Article 184Our study is limited to defining these conditions and the extent to which they support the functions of the current Constitutional Counci
