More than ten years after the introduction of the Article 175 bis 1 of the Penal Code, the criminal code has not deterred illegal immigrants from committing their acts, and controversy has persisted since the parliamentary debates of Act 09-01 amending the Penal Code to this day on the efficacy of penalisation of illegal departure of the territory, and whether the penalties observed are appropriate to the offense, which led us to discuss this subject to identify the elements of the crime of illegal departure and the penalties prescribed for them, and to detail the various controversial points related to this subject.
