However, the development of wars led to the existence of flagrant violations of international legal norms governing the state of war (international humanitarian law), and the provision of war crimes, whether in international custom or international conventions, such as restrictions on the use of the right to war in order to limit its release, The two armies must follow a specific law to control and organize these acts, which also led to the need to establish judicial bodies to follow up and punish the perpetrators of these violations, whatever their contribution and whatever their degree civil or even military.

These judicial bodies have been credited with developing the rules of so-called international criminal law.
