عرف القطاع الفلاحي في الجزائر تطورا مستمر من حيث المنظومة القانونية بحثا عن سياسة فلاحية موحدة غير أنه امتاز بعدم الاستقرار و الثبات الأمر الذي خلق صعوبة في توحيد النصوص المنظمة لاستغلال العقار الفلاحي هذا ما أدى إلى تداخل في الاختصاص بين هيكلين قضائيين ( القضاء العادي و القضاء الإداري)
Abstract EN
The agricultural sector in Algeria has witnessed a continuous development in legal texts, in order to search for a unified agricultural policy, however, it was characterized by instability, this matter made it difficult to standardize legal texts related to the exploitation of agricultural real estate, this is what led to conflict of jurisdiction between the ordinary and administrative courts.
