عرف القطاع الفلاحي التابع للأملاك الخاصة للدولة أنماطا عديدة للإستغلال إلا أن هذه الأخيرة باتت بالفشل وذلك لعدة أسباب أهمها غياب رقابة الدولة على عملية الإستغلال و التي ساهمت في ظهور عدة ممارسات غير شرعية الأمر الذي دفع بالدولة إلى فرض رقابة شديدة على شروط وكيفيات الإستغلال وذلك بتبني عدة آليات أهمها توسيع الإختصاص الرقابي للديوان الوطني للأراضي الفلاحية إلا أنه لا تتوقف حماية إستغلال العقار الفلاحي عند تدخل الجهات الإدارية فقط حيث قد يستمر الخلاف و النزاع إلى حد يستوجب تدخل الهيئات القضائية
Abstract EN
The agricultural sector depending on the estate of state has know several types of exploitation, the inefficiency of these systems imposed a rigorous control to the conditions and methods of exploitation.
This mission was entrusted to the national office of agricultural lands.
it was entrusted to judiciary competent authorities a control in order to resolve the litigations arising with the concession contract.
