The time-sharing contract is the contract that allows the subscriber to use permanently or temporarily a certain tourism unit, in partnership with other subscribers with the difference in the period of use between each of them, and this contract has been legally regulated by some comparative legislation without Algerian legislation and therefore it is not named in it, from it a problem is raised about the rules applied to it, and about determining its legal nature.

as this study concluded that it adapts according to its image, so either a sale contract of a special nature transfers the ownership of the subscriber's time share, or it is a contract private lease transferring the right of use, and accordingly, this contract is subject to a mixture of texts applicable to each of them, taking into account some special issues in it that are subject to its own provisions.
