The International Criminal Court is the mainstay in ensuring that perpetrators of the most serious crimes do not go unpunished, and in this way the court contributes to achieving the primary goal stipulated in the United Nations Charter, which is the promotion of human rights, but the impact of the Security Council ( a political body) on the jurisdiction of the court (a judicial body) makes it clash with the imperatives of maintaining international peace and security, which is determined and adapted to the will of the permanent members, especially since the process of determining the occurrence of aggression is an inherent jurisdiction of the Security Council.
