يعد التعويض الغاية الأساسية التي يسعى إليها المتضرر جراء الضرر الذي لحق به سواء كان ماديا أو معنويا و لا تثير مسألة تعويض الضرر في المسؤولية المدنية أي إشكال إذا كان الضرر ماديا أما إذا كان الضرر معنويا فان هذا الأخير كان محل خلاف حول طبيعة و أساس التعويض عنه بالإضافة إلى صعوبة تقديره باعتباره ضرر نفسي داخلي.
نسعى من خلال هذه الدراسة إلى تحديد طبيعة التعويض عن الضرر المعنوي و البحث عن المعايير المعتمدة في قدير التعويض عنه
Abstract EN
Compensation is the basic goal sought by the victim as a result of the damage caused to him whether this damage is material or moral, compensation for damage to civil liability does not raise any problems in case of material damage, but moral damage was disputed over the nature of compensation, in addition it is difficult to estimate.
In this study we will determine the nature of the compensation for this damage and the criteria used in estimating compensation.
