Arabic Abstract

تداولت هذه الرسالة موضوع التنظيم القانوني للشروع في الجرائم الإلكترونية دراسة مقارنة و ذلك من خلال أربعة فصول متكاملة، و قد خصص الفصل الأول للإطار النظري و الذي تداول مشكلة الدراسة التي تمثلت بوجود فراغ تشريعي المتمثل بعدم وجود نص يعاقب على الشروع في الجرائم الإلكترونية الأردني بالمقارنة مع قانون مكافحة جرائم تقنية المعلومات الغماني، كما وتم تناول أهداف الدراسة و كان أهمها تقديم دراسة تأصيلية لموضوع الشروع في الجريمة الإلكترونية.

في حين تم تداول الجريمة الإلكترونية في الفصل الثاني، حيث ارتأت الباحثة تقسيمه إلى التعريف بالجريمة الإلكترونية و بيان بنيادها القانوني.

بينما تناولت الباحثة في الفصل الثالث الشروع في الجريمة الإلكترونية من حيث بيان ماهيته و موقع الشروع من مراحل الجريمة الإلكترونية فضلا عن تناولها لأركان الشروع في و توصيات، و كانت أهم هذه النتائج إمكانية تصور الشروع في الجريمة الإلكترونية من علمها.

و أخيرا وليس أخرا، تناولت الباحثة في الفصل الرابع الخاتمة التي توصلت إلى عدة نتائج أما بالنسبة لأهم التوصيات فقد تمثلت بتوصية الباحث للمشرع الأردني أن يقوم بإدخال نص في قانون الجرائم الإلكترونية من أجل العقاب على الشروع في الجنح الإلكترونية و الخروج على القواعد العامة المنصوص عليها في قانون العقوبات الأردني .

English Abstract

This study was concerned with the subject of attempting electronic crimes, comparative study through four main chapters, preceded by an introductory chapter (the theoretical framework of the study) in which it dealt with the problem of the study represented by a legislative vacuum in the initiation of electronic crimes in Jordan in comparison with the Omani information technology crime law, and addressed this most important framework The aims of the study, which is to present a proposal for a Jordanian legal text that criminalizes attempting electronic crimes, similar to the Omani law.

While e-crime was dealt with in the second chapter, the researcher decided to divide it into the definition of electronic crime and explain its legal structure.

While the researcher in the third chapter dealt with the initiation of electronic crime in terms of explaining what it is and the location of the initiation of the stages of electronic crime as well as its discussion of the pillars of the initiation of electronic crime.

Last but not least, the researcher discussed in the fourth chapter the conclusion that reached several conclusions and recommendations, and the most important of these recommendations was the possibility of visualizing the attempt on electronic crime or not, just as the initiation of electronic crime consists of the same pillars that constitute the initiation of the general theory stipulated in Criminal Law.

As for the most important recommendations, it was represented by the researcher’s recommendation to the Jordanian legislator to enter a text in the electronic crime law that is based on organizing the provisions for initiating these crimes and explaining the basis for punishment.
