Abstract EN

This article aims to study the reasons that have prevented regulations from being subject to the control of the Algerian constitutional council.

That it is due to three basic reasons: The first is to imitate the French model despite its specificity in establishing a constitutional council to control parliament, not the government and regulations.

The second is that Algerian jurisprudence has been affected by its French counterpart.

The third of them is the pivotal role of the President of the Republic in the Algerian constitutions and his exclusivity in amending the constitution in a way that inflates his powers and does not place any control over him.
