Therefore, the constitutions of the states in general, including the Algerian and Egyptian constitutions, provided for two types of immunity, substantive immunity and procedural immunity, one of the two hypotheses put forward as basis for the problem of our subject, whether this immunity is a privilege or is it a guarantee in favor of the parliamentarian.

this is reflected in the independence of the legislature and the principle of separation of powers in the two countries, the revolution in Egypt and the popular movement in Algeria have had a clear effect in raising the ceiling of applications submitted to the parliament, concerning activating the procedures of lifting parliamentary immunity from its members, To open the way for the judiciary to follow up.
