يهدف هذا البحث إلى تسليط الضوء على تقنية هامة كرسها المنظم الجزائري لتسيير المرافق العمومية لاسيما المحلية منها من خلال الاعتماد على أسلوب تفويض المرفق العام وذلك بتحويل بعض المهام غير السيادية التابعة للسلطات العمومية لمدة محددة إلى المفوض له بهدف تحقيق الصالح العام حماية المال العام ضمان الجودة و النجاعة في الخدمة العمومية بفضل الأدوات القانونية الرقابية التي كرسها المرسوم التنفيذي رقم 18/199 لفائدة الجماعات الإقليمية بشكل صريح حيث تبين لنا من خلال الدراسة إيلاء أهمية بالغة للرقابة على اتفاقيات تفويض المرفق العام للجماعات الإقليمية تراوحت بين الرقابة القبلية و الرقابة البعدية غير أن فعالية أشكال الرقابة و تحقيق الغرض المتوخى منها مرهون بمدى فعالية اللجان المختصة و كفاءة و تأهيل الموظفين المعينين على مستواها و كذا فعالية و حياد السلطة المفوضة.

Abstract EN
The purpose of this research is to shed light on an important technique devised by the Algerian regulator for the management of public services, especially local services, by relying on the method of delegation of the public service, by transferring to the delegate certain non-sovereign missions relating to public authorities for a limited period, in the interest of general interest and protect public funds, guarantee the quality and performance of public service delivery, through the legal instruments of control established by Executive Decree No 18 / 199 for local Communities, And the study shows that the importance of supervising over the Convention delegation public service of local Communities, which include a priori control and a posteriori control.
However, the effectiveness of the forms of control and the achievement of their objective depend on the effectiveness of the relevant committees and the efficiency and qualification of the staff concerned at their level, as well as efficiency and impartiality delegated authority.

Cette recherche a pour objectif de faire la lumière sur une technique importante consacrée par le régulateur Algérien à la gestion des services publics, notamment locaux, en s'appuyant sur la méthode de délégation du service public, en transférant au délégataire certaines missions non régaliennes relevant des autorités publiques pour une durée limitée, dans le bute de l'intérêt général et de protéger des fonds publics, garantir la qualité et de performance de la prestation du service public, grâce aux instruments juridiques de contrôle établis par le décret exécutif n ° 18/199 au profit des collectivités territoriales, Et l'étude montre que l'importance de superviser les contrôle des conventions délégation de service public des collectivités territoriales, qui comprennent un contrôle a priori et un contrôle posteriori.
Toutefois, l'efficacité des formes de contrôle et la réalisation de leur objectif dépendent de l'efficacité des comités compétents et de l'efficacité et de la qualification du personnel concerné à leur niveau, ainsi que de l'efficacité et de l'impartialité du pouvoir délégué.
