The subject of the research deals with the provisions of selling the property of others, which is one of the thorny issues on the legal and legal reality, because if a person disposes of the property of others by selling without his permission, it is considered an attack on the ownership of others, something that has led the scholars of Sharia and law to put a special protection for the owner that prevents others from attacking On his possession.

Accordingly, I will address in this study a statement of the rules that govern the sale of the property of others in the Algerian civil law, and compare them with the provisions of Islamic jurisprudence as I could as a way, taking into account that concise and clarity.
