Abstract EN

: The Rule of Governmental Solidarity in the Algerian Legal System is considered as a regulator of the government's action, it forms a constitutional determinism enshrined by the different algerian constitutions.

It has also a definite signification, by virtue of which the government's member, whatever is his title, with or without a ministerial portfolio, is bound to execute and consolidate the requirements of solidarity with its government's members colleagues; who form a common solidarity unity which is reflected on the government action plan considered as the first document enshrining the government unity in parliament or press confrontation.

In addition of the role played by the different deliberative councils considered as the ideal space to practice the government's common action through the deliberation on the different issues of public interest.

However, despite of the constitutional enshrining of the government solidarity rule, and its statute of constitutional determinism having a compulsory character, which is the general principle communicated in the official texts applicable in practice, its scope is not open but limited by some exceptions made valid by the practical requirements, as the very interest of the Ministry and the necessity to work on its unity and cohesion as well as the political motivations and the specificity of the statute of some ministers in the government.
