Abstract EN

The study deals with analyzing the checker's crime and the holder, when it's is offered for trading in a manner that violates it's legal system, emphasizing that this paper is the only one that has been granted with penal protection, whether in the penal or commercial code, When its use was contrary to its nature, also the discussion of this crime through the reforms that the legislator has introduced to the check regime and the crime of issuing a check without credit, under the Law n° 05-02 about the Commercial code, as well as the provisions of the Law n°15-02 about the Criminal Procedures code, in addition, focusing on Regulation n° 11-07 related to the prevention and combating issuing checks without credit, the study concludes by stating of the importance of legal reforms and their consequences, especially as these amendments came to put an end to transactions affecting the check system and involving the financial institutions in the process of combating this crime.
