استحدث المؤسس الدستوري الجزائري بموجب تعديل سنة 2016 الدفع بعدم الدستورية كآلية تسمح لذوي المصلحة أنفسهم بالدفاع على حقوقهم وحرياتهم التي يضمنها لهم الدستور ضد الأحكام التشريعية التي قد تنتهكها فالدفع بعدم الدستورية وعلى خلاف الدعوى الدستورية الأصلية يعتبر من وسائل الدفاع المهمة التي يريد من خلالها أحد أطراف الدعوى الأصلية – أيا كانت طبيعتها مدنية إدارية جزائية.

الخ - اتقاء الحكم عليه بناء على نص تشريعي يرى فيه بأنه ينتهك الحقوق و الحريات التي يضمنها الدستور.
و لأن إثارة الدفع بعدم الدستورية بعد أن دخل رسميا حيز النفاذ بتاريخ 07 مارس 2019 تعتبر في الفقه الإجرائي من المسائل العارضة التي يتعين على قاضي الموضوع نظرها وإبداء موقفه منها فإن ذلك من دون شك سيكون له تأثير من الناحية القانونية على سير الدعوى الأصلية.

Under the 2016 amendment, the exception to unconstitutionality was adopted for the first time in Algeria as a mechanism allowing stakeholders to defend themselves from the rights and freedoms guaranteed to them by the Constitution against legislative provisions that could violate them; The exception to unconstitutionality, unlike the original constitutional case, is A defensive means to avoid judging a person on the basis of a legislative provision contrary to the Constitution.
and because the exception to unconstitutionality has officially become enforceable after March 07, 2019, its movement is an incidental issue that undoubtedly has an impact on the actions of the original case.
