في الآونة الأخير إزدهرت الجراحة التجميلية بشكل متزايد و أدى إقبال الناس عليها إلى رواجها و خاصة بعض الفئات مثل الفنانين و أصحاب المهن الخاصة التي تتطلب مظهرا معينا و أمام هذا الإقبال عليها باتت تطرح عدة تساؤلات: فهل هي نوع من الجراحة العامة و تنطبق عليها قواعد المسؤولية الطبية نفسها أم أن لها قواعد و مسؤولية خاصة بها إن تسليط الضوء على هذا النوع من الجراحة هو إفتقارها إلى مبرر التدخل الجراحي و هذا الأخير يفتقر إلى الهدف منه وهي "بقصد العلاج" مما يجعلنا نسلط الضوء على مسؤولية جراح التجميل القانونية المدنية منها و الجزائية و خصوصا عندما يرتكب خطئـا طبيا و سنتطرق إلى النتائج المترتبة عن قيام كل نوع منهما.

Abstract EN
Recently, cosmetic surgery has blossomed more and more and the people's interest in it has led to its reverence, especially some categories like artists and private professions requiring some appearance; Faced with this interest, several questions have been raised like: what to which a kind of general surgery is which the rules of medical? responsibility apply? Or do they have their own rules and responsibilities The focus of this type of surgery is that it lacks the justification for the surgical procedure because it lacks the "treatment" goal, which makes us highlight (highlight) the responsibility of the plastic surgeon and criminal, especially when he commits a medical error and we will.
